The Department of Labor’s Wage and Hour Division (WHD) has issued some much-anticipated guidance regarding the Families First Coronavirus Response Act (FFCRA), which contains a variety of measures, including the Emergency Paid Sick Leave Act and Emergency Family and Medical Leave Expansion Act. The legislation outlined federal leave obligations for employers with fewer than 500 employees but left many unanswered questions about its practical application.

In this “first round of information and compliance assistance,” WHD clarifies that the FFCRA will take effect on April 1, 2020, and addresses questions such as how an employer must calculate its number of employees to determine coverage and how to count hours for part-time employees.
