SHARE YOUR FEEDBACK ON THE PROPOSED REVISIONS TO OFCC CMR DOCS Deadline for Comments: September 10 

As we had shared previously, the Ohio Facilities Construction Commission is updating three sets of its contract documents: Construction Management at Risk (CMR), Design Build and General Contract. AGC of Ohio has the opportunity to submit comments and meet with OFCC during the revision process. 

AGC just received the first round of revisions to the CMR contract. Links to the revised contract and a page to submit your feedback are below. We ask that you share any feedback with us by Tuesday, September 10. AGC will assemble the comments and share them with a volunteer workgroup of members familiar with OFCC contracts, who will review the recommended changes and help prioritize them.

 MARK YOUR CALENDAR FOR THE AGC OF OHIO CONVENTION IN NAPLES, FLORIDA 

Planning is underway for the annual convention scheduled for March 3-9, 2025 at La Playa Resort. Keep an eye out for registration information, which will be sent in September. 

BUILD OHIO PROJECT ENTRIES DUE TOMORROW, AUGUST 23! 

Don’t forget to submit your project for the Build Ohio awards competition! Eligible projects must be located in Ohio and completed between August 1, 2023 and July 31, 2024. Award categories are new construction, renovation, specialty, transportation, and industrial/heavy. 

The Build Ohio Celebration will be held on the evening of November 15. The gala recognizes the industry’s achievements, and the winning Build Ohio projects will be announced for the first time in Academy-Awards style. Registration information will be sent early September, and sponsorship opportunities will be available.

AGC Argues for Proper Interpretation of Construction Industry Exemption from Withdrawal Liability in Amicus Brief: On August 2, 2024, AGC of America filed an amicus brief in a case concerning the scope of the “building and construction industry” exemption from multiemployer pension fund withdrawal liability under the Employee Retirement Income Security Act of 1974 (ERISA). 

Construction Employment Increases In 39 States Between July 2023 And July 2024: Construction employment increased in 39 states in July from a year earlier, while 29 states and the District of Columbia added construction jobs between June and July, according to a new analysis of federal employment data released by the AGC of America. “Construction employment gains remain widespread, thanks to steady or increasing demand for data centers, manufacturing plants, energy and infrastructure projects,” said Ken Simonson, the association’s chief economist. “But further job growth may be hindered by a lack of training programs for construction careers.”

Managing Design in Design-Build – Contract Language is Critical for Success: A design-builder should be able to withhold payment for deficient work. The AIA protects Architects from being managed but ConsensusDocs gives better rights for owners and design-builders to withhold payment for faulty or late design services work product.

AGC Lean Construction Committee Launches New Series to Promote Lean Construction Methodology: In a new “Why Should YOU Adopt Lean” educational material series, members of the AGC Lean Construction Committee integrate impactful research with approachable “get started” guide to help more contractors adopt Lean Construction Methodology in the field.
